Reusable options for take away.

From 1 January 2024, restaurants and other establishments in Sweden that offers their customers food and drinks in disposable cups and food packaging also needs to offer reusable options. We explain what the law entails, what requirements are placed on affected businessess and how you can get reusable take away options for your business.

FROM JANUARY 1, 2024

New law for take away products: Restaurants and cafés in Sweden must offer reusable packaging for take away.

From January 1, 2024, restaurants, cafés, grocery stores and other food service establishments in Sweden that offer their customers food and drinks in disposable mugs and food containers must also offer reusable options for take away.

The goal of the law is to reduce the consumption of disposable mugs and food containers by 50% by 2026.

The background to the law is the EU's Single-Use Plastics Directive, which was adopted in July 2021 and came into effect in Sweden in January 2022. The goal of the directive is to reduce the amount of plastic in the oceans and move towards a more circular economy. Read more about the EU's Single-Use Plastics Directive.

3 IMPORTANT POINTS

The law in brief:

> Restaurants and other food service establishments that sell more than 150 meals or drinks served in disposable take-away packaging need to offer reusable options. If your packaging is made of plastic or has a thin plastic coating on the inside, you are affected by the law."

> The reusable packaging must be used multiple times, i.e. circulate. This requires that the multi-use packaging is included in a rotation system, where collection, cleaning and reuse is possible.

>You need to inform your customers about the opportunity to have their take away served in reusable packaging and the benefits of reduced consumption.

ReturnMe - Frågor och svar

Information.

52 VECKOR

Vad ingår mer i tjänsten?

When will the law come into effect?

The new law will come into effect on January 1st, 2024.

Why is the law being introduced?

The goal of the law is to reduce the consumption of single-use cups and food containers by 50% by 2026.

The background for the law is the EU's Single-Use Plastics Directive, which was adopted in July 2021 and came into effect in Sweden in January 2022. The goal of the directive is to reduce the amount of plastic in the oceans and move towards a more circular economy.

What does the law entail?

If you serve more than 150 portions or drinks every day in single-use containers, you will also be required to offer reusable take-away containers. You don't have to stop using single-use products, but you need to be able to offer serving in reusable cups and food containers. This applies to both food and drink.

The restaurant should also take measures to ensure that the reusable cups and food containers are also used and rotate multiple times.

In addition, you should inform your customers about the possibility of reusable alternatives and the benefits of reduced consumption of single-use options, as well as the environmental impact of using single-use cups and food containers.

Which single-use cups and food containers are covered?

Almost all single-use food containers and cups are covered by the law. Both in terms of material (plastic, paper, etc.) and usage areas (sushi boxes, food containers, hamburger boxes, salad bowls, and cups for hot and cold drinks.

It is only if you offer cups and food containers made of 100% paper or 100% cardboard (not chemically modified paper) that you are not affected by the requirement to offer reusable products. However, this is uncommon as most cups and food containers on the market have a plastic coating on the inside.

Are there any products that are exempt?

In addition to products made of 100% cardboard or paper (not chemically modified paper), pizza boxes and so-called flexible wrappings are exempt from the law. Examples of flexible wrappings include sandwich wrapping paper or plastic film around a sandwich.

Does the law also apply to food packaging?

The law applies to fast food served in a food container.

Fast food means food that:

1. is intended to be eaten directly at the point of sale or taken away to be eaten shortly after sale at another location,
2. is intended to be eaten out of the container, and
3. is ready to eat without further preparation, heating or other preparation performed by the consumer.

To some extent, food sold in grocery stores may be subject to the law, but food that is frozen or needs further cooking or is sold in large packages is not covered.

Candy and ice cream wrappers are also excluded.

Are any restaurants and food establishments exempt from the law?

Smaller businesses are exempt from the law. A restaurant or food establishment is considered a smaller business if they consume less than 150 single-use cups and food containers on average per day they are open during a calendar year. (From 2026, 75 will apply.)
